Terms and conditions
I. General Provisions
- This document sets out the general terms and conditions of sales conducted by Kacper Skobejko, operating under the business name Kacper Skobejko AMZ Digital Hub, entered into the register of entrepreneurs of the Central Registration and Information on Business Activity (CEIDG), maintained by the minister responsible for economy, at ul. Flagowa 9/7, 02-431 Warsaw, NIP 5223257218, REGON 525215955, BDO 000626184, hereinafter referred to as the Seller.

b. phone number: +48 504 242 487; - These Distance Sales Terms are continuously available on the website in a way that allows their retrieval, reproduction, and storage by printing or saving at any time.
- The Seller informs that the use of electronic services may involve risks for any Internet user, including the possibility of malicious software entering the Client’s IT system and the risk of data being obtained or modified by unauthorized persons. To avoid such risks, the Client should use appropriate technical measures, in particular antivirus software and a firewall.
II. Definitions
- Business Days – days from Monday to Friday, excluding public holidays;
- Client - a natural person with full legal capacity, a natural person conducting business activity, a legal person, or an organizational unit without legal personality but with legal capacity under specific provisions, placing an Order under these Terms;
- Civil Code – the Act of 23 April 1964 (Journal of Laws No. 16, item 93 as amended);
- Consumer – a Client who is a consumer within the meaning of Article 22¹ of the Civil Code;
- Online Store – the online store cinematio.com operated by Kacper Skobejko AMZ Digital Hub;
- Listing – information published by the Seller on an external online platform, specifying that an Order for a given Product may be placed and providing its description. A Listing constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code;
- Online Platform (Platform) – an external website on which the Seller publishes Listings, available at cinematio.com;
- Entrepreneur – a Client who is an entrepreneur within the meaning of Article 43¹ of the Civil Code;
- cinematio.com Terms and Conditions – rules for providing services and concluding sales agreements on cinematio.com;
- Seller – Kacper Skobejko, operating under the business name Kacper Skobejko AMZ Digital Hub, entered into CEIDG at ul. Flagowa 9/7, 02-431 Warsaw, NIP 5223257218, REGON 525215955, BDO 000626184;
- Product – a product presented in a Listing, with its description available for each item;
- Sales Agreement – a sales agreement within the meaning of the Civil Code concluded between the Seller and the Client;
- Consumer Rights Act – the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827);
- Terms of Sale – this document;
- Order – a declaration of intent by the Client aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Products.
III. Procedure for Concluding a Sales Agreement
- Information about Products provided in Listings, in particular descriptions, technical and functional parameters, and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
- All Products available in the Online Store have been legally introduced to the Polish market and comply with the Agreement, except for used Products whose specific features deviate from conformity requirements. The Seller will inform the Client in the product description which features deviate from conformity requirements and will provide technical means enabling the Client to separately and explicitly accept such features.
- If the Seller uses automated price personalization mechanisms, this information is provided to the Consumer each time an Order is placed, in accordance with personal data protection regulations.
- A valid email address is required to place an Order.
- When placing an Order via the form available at www.cinematio.com, the Order is submitted electronically and constitutes an offer to conclude a Sales Agreement. The offer is binding if the Seller confirms acceptance of the Order to the Client’s email address.
- Orders placed via email may be submitted on Business Days between 8:00 and 16:00. The Client should:
a. specify the Product name and quantity,
b. choose delivery method and payment method,
c. provide required data such as name, address, company details, delivery address, and email. - The total Order value is provided by the Seller via electronic message, along with information that payment is required. At that moment, the Sales Agreement is concluded.
- For Consumers, the Seller sends confirmation of the Order terms after placement.
- The Agreement is concluded when the Consumer accepts the Order terms and confirms acceptance of the Terms of Sale and withdrawal policy.
- After conclusion, the Seller confirms the Agreement terms via email, written form, or private message.
- The Sales Agreement is concluded in Polish or English.
IV. Delivery
- Delivery is limited to the European Union and carried out to the address provided by the Client.
- Delivery methods include:
a. courier,
b. parcel locker,
c. postal operator,
d. personal pickup. - Delivery time and cost are specified in the Product description.
- Delivery time is counted in Business Days.
- Proof of purchase is provided.
- If different delivery times apply, the longest applies.
V. Prices and Payment Methods
- Prices are in Polish zloty and include VAT and all charges.
- Payment methods:
a. online payments such as PRZELEWY24 / STRIPE,
b. bank transfer (processing starts after confirmation and shipping after payment is received). - The Client is informed about the payment deadline. Failure to pay may result in contract withdrawal.
VI. Right of Withdrawal
- A Consumer may withdraw from the Agreement within 14 days without giving a reason.
- The declaration may be submitted using a form.
- The period starts from delivery of the Product.
- Confirmation of receipt of withdrawal is sent by email.
- The right of withdrawal does not apply to:
a. custom-made goods,
b. sealed goods that cannot be returned after opening for hygiene or health reasons,
c. other cases under Article 38 of the Consumer Rights Act. - Upon withdrawal, the Agreement is considered not concluded. Products must be returned within 14 days.
- Refunds are made within 14 days using the same payment method unless otherwise agreed.
- Additional delivery costs are not refunded if a more expensive delivery method was chosen.
- The Client bears the direct cost of return unless otherwise agreed.
VII. Complaints
- The Seller is obliged to deliver Products in conformity with the Agreement.
- Liability rules apply to Consumers and certain Entrepreneurs; warranty for businesses is excluded.
- Complaints should be sent to the Seller’s address or email.
- Products should be returned for complaint handling where possible.
- Complaints are processed within 14 days.
- Missing information must be completed within 7 days.
VIII. Out-of-Court Dispute Resolution
Consumers may use:
a. consumer arbitration courts,
b. mediation with trade inspection authorities,
c. free consumer assistance organizations,
d. EU ODR platform.
IX. Personal Data Protection
Personal data is processed in accordance with applicable law and provided information clauses.
X. Final Provisions
- Certain Consumer rights also apply to entrepreneurs acting as consumers.
- Consumer disputes are handled by competent courts.
- Entrepreneur disputes are handled by courts competent for the Seller’s seat.
- Matters not regulated are governed by Polish law and relevant regulations.
- Clients will be informed of changes at least 14 days before they take effect.
- The Terms of Sale are available in Polish.
